Overview

Kevin Rasp defends healthcare providers with the insight of someone who understands what it means to care for patients in the hospital, clinic, or nursing setting. He litigates with strategic precision, charisma, and creativity in Illinois, Indiana, and Iowa. He is also licensed to practice in federal jurisdictions across the Midwest and has litigated to trial and through appeals in Virginia. His litigation prowess in medical malpractice, wrongful death, and cases alleging violations of the Illinois Nursing Home Care Act stems from his comprehensive understanding of healthcare regulations and clinical standards.

Clients value Kevin’s ability to distill complex medical concepts into persuasive legal arguments that win with judges and juries. He is also sensitive to his clients’ reputational concerns and, when representing corporate entities that provide care, their business considerations. Kevin’s work on behalf of healthcare clients is not limited to defending them in medical malpractice, nursing neglect, and wrongful death lawsuits, but also includes defending them against discrimination and harassment claims before state and federal authorities like the Illinois Department of Human Rights, Iowa Civil Rights Commission, and the EEOC. Kevin knows, from years of practice, that a specialized employment setting like a skilled nursing facility requires a dedicated and focused healthcare employment lawyer.

Kevin's representation of directors and officers in breach of fiduciary duty and fraud claims demonstrates his versatility. Kevin also brings analytical rigor and technical acuity to representing auto manufacturers in high stakes product liability cases involving serious injury or death. While healthcare law is his primary focus, his adaptive litigation readiness allows him to excel across practice areas. As he often says, lawsuits end in one of three ways: motion, settlement, or trial. He works with clients to determine which outcome to pursue and achieve.

Kevin has taught legal writing at Loyola University Chicago School of Law since 2013. He currently teaches an advanced legal writing class that he developed called Legal Writing for the Medical Malpractice Trial: The Expect Challenge, which focuses on the Frye and Daubert case law, reviews how different jurisdictions evaluate the expertise of medical experts and requires students to draft and argue motions to exclude novel expert opinions. As a professor, Kevin demonstrates his commitment to mentoring the next generation of lawyers. He brings this commitment to O’Hagan Meyer, where he is a leader of the firm’s Summer Associate Program and well-liked “professor” of the firm’s summer associates and new associates.

  • Defended a Virginia skilled nursing facility through three years of litigation to win a defense verdict in a wrongful death claim after two weeks of trial in 2026
  • Retained as national trial counsel for a management company of skilled nursing facilities, representing the company and its affiliates in numerous injury, death, and commercial disputes for more than ten years
  • As an associate and a partner, represented various automakers to defense verdicts in multiple injury and death lawsuits in Illinois and Wisconsin
  • Negotiated resolution of a breach of fiduciary claim against the founders of Obamacare insurance co-op
  • Defended bus driver who lost consciousness and lost control of bus, killing multiple passengers, in high-profile litigation in Minnesota
  • Settled countless nursing neglect and wrongful death claims through mediation and direct negotiations with opposing counsel at all stages of litigation
  • Represented numerous physicians and hospitals through Indiana’s Medical Review Panel process to present the medical defenses to medical malpractice claims before a panel of reviewing physicians
  • Won a satisfactory outcome in a FINRA arbitration involving a claim by spurned CEO against a financial services firm

Community

Kevin is a member of the reinvigorated Professionals Board of CARPLS, a 501(c)(3) nonprofit and Cook County’s largest provider of pro bono services. CARPLS is focused on helping low- and moderate-income Illinoisans through their legal issues with its telephone hotline, where volunteer lawyers provide legal advice and legal “help desks” in the local courthouses. These services help individuals advocate for themselves and, where appropriate, connect them with other legal aid organizations or other resources. Kevin has worked with the organization on and off since 2007, when he staffed the hotline as a volunteer. Now Kevin helps with fundraising and strategic planning as part of the volunteer Professionals Board.
