Overview

With deep industry knowledge, extensive trial experience, and practical risk management strategies, O’Hagan Meyer’s Design Professionals team is widely regarded as one of the nation's leading groups. We have represented clients through all phases of the design process—from project ideation and design through construction and project completion.

We have handled some of the industry's most significant disputes, including ones involving billion-dollar projects, and understand the distinct legal and professional obligations that govern design professionals and tailor our counsel accordingly.

Our team represents architects, engineers, surveyors, design-build professionals, and their insurers in matters involving professional liability, project delivery, contractual risk allocation, and regulatory compliance. We regularly defend claims involving professional negligence and malpractice, design errors and omissions, alleged breaches of contract and warranty, construction administration and project oversight issues, delays, cost overruns, redesign expenses, property damage, catastrophic injury, and wrongful death. Many of these matters turn on questions of professional judgment, scope of services, and compliance with the applicable standard of care.

We represent clients in state and federal courts, arbitration proceedings, mediations, regulatory matters, and other dispute resolution forums nationwide. We also provide coordinated defense and coverage strategies informed by our extensive experience representing various industry participants and professional liability insurers.

Beyond defense, our team counsels clients on the full range of contractual and risk-allocation issues that affect design firms before disputes arise. We assist with contract drafting and negotiation, indemnity provisions, insurance requirements, limitation-of-liability clauses, standard-of-care provisions, scope-of-services definitions, performance obligations, and other contractual mechanisms designed to appropriately allocate project risk and avoid the assumption of contractor-type responsibilities. Our lawyers also advise clients regarding claim prevention, risk management strategies, and project-specific exposure assessment throughout the project lifecycle.

Drawing on substantial experience with design-bid-build, design-build, and other alternative project delivery methods, we help clients navigate the liability, coordination, and documentation challenges that arise when design and construction responsibilities intersect. We regularly advise on project documentation, design coordination, construction administration, schedule impacts, supply-chain disruptions, unforeseen conditions, and disputes over responsibility for delays and cost overruns.

We also counsel clients on licensing and regulatory compliance, professional responsibility matters, and intellectual property and copyright issues involving plans, specifications, and other design documents. Our experience includes advising on ownership and permitted use of design materials, protection of architectural and engineering work product, and related risk-management considerations.

O’Hagan Meyer’s Design Professionals team includes lawyers with prior training and experience in architecture and engineering, providing firsthand insight into the technical, operational, and business challenges design firms face. Familiar with project delivery methods, construction documentation, coordination responsibilities, and the realities of project execution, we identify issues early and develop practical, business-minded strategies to mitigate risk and protect our clients' interests.

Clients value our responsiveness, practical counsel, and ability to align our legal strategy with their project and operational goals. With a national platform, strong trial capabilities, and extensive experience representing design professionals and their insurers, we provide effective advocacy and strategic guidance at every stage of a matter.
