Victory in Denver Trial Defending Healthcare System

Denver Partners Alice Conway Powers and Meredith McDonald, with able assistance from associate Brian DeMocker in the lead up to trial and from associate Tate Hughes during the trial proceedings, recently obtained a defense verdict in a Denver District Court jury trial before Chief Judge Christopher Baumann. Alice and Meredith successfully defended a Topeka, Kansas based healthcare system against claims for breach of contract and defamation, which arose out of a contract for the provision of clinical radiation physics services to the health system's oncology center. Plaintiffs alleged that an employee for the healthcare system defamed the contractor's owner and sole employee, which led to Defendant breaching the contract for services between the Plaintiff entity and the Defendant. The contractor Plaintiff had also brought a claim for breach of the duty of good faith and fair dealing, which it agreed to withdraw upon the conclusion of its case.

During closing arguments, Plaintiffs asked the jury to award $2,600,000 in damages. After only an hour and a half of deliberation, the jury returned a verdict in favor of the defense on both claims. Our client will also be awarded costs of litigation. Our client was thrilled to see a just verdict and to sustain its pristine reputation for its patients and the community!
