Overview

In and out of state and federal courts and in mediation and arbitration, Maurice Fitzgerald is a sought-after litigator, trial advocate, and mediator who resolves employment law and general litigation disputes. For more than three decades, he has represented individuals, partnerships, organizations, and corporations in all manner of dispute resolution. His experience includes navigating clients through lawsuits involving employment, real estate, construction, personal injury, and commercial claims across the country.

Maurice’s employment experience ranges from litigation of employment discrimination and harassment under the Fair Employment and Housing Act (FEHA), the Unruh Act, and Federal law to disability discrimination matters under Title III of the Americans with Disabilities Act. He counsels clients on all aspects of the FEHA, and the development of preventive policies and procedures to reduce the potential for employment and fair housing disputes into the future.

Having received his formal mediation training at the Harvard Negotiation Institute in Cambridge, Massachusetts, Maurice has mediated hundreds of cases to conclusion as both a mediator and advocate. Notably, he serves as panel mediator for the Marin County Superior Court. Maurice’s highly cultivated and extensive mediation experience provides him with unique insights into how judges and opposing counsel evaluate cases, enabling him to develop more effective litigation strategies and achieve superior outcomes for those he serves.

Having cultivated a dual perspective, developed through representing employees and management, Maurice conducts seminars and lectures to consumer advocacy groups, general counsel, and defense organizations on a multitude of litigation issues. He regularly advises on and educates clients and the greater community regarding the Fair Employment and Housing Act, claims prevention, fair employment hiring and firing practices, FMLA/CFRA rights and compliance, independent contractor classification matters, and wage and hour issues.
